General Terms and Conditions

INTRODUCTION

These General Terms and Conditions (the “General Terms”) and all of the documents and other terms referred to and included in them and which comprise together the “Terms of Use” (as defined in clause 2.1). They apply to you whenever you use any applicable aspect of the Services Paddy Power (as defined in clause 1.4). References to “you” and “your” are to you, as the end user of the Services. For more information about who “we” are, see clause 1.

PLEASE READ THIS SECTION BEFORE YOU MOVE ON TO THE REMAINDER OF THESE GENERAL TERMS

It is important that you take the time to read and understand these General Terms as well as all the other applicable parts of the Terms of Use because they affect your rights. In some cases, they may result in you not being paid by us, or being excluded or prevented from playing with us, or other actions being taken by us that may affect your interests. If you have any questions about anything contained in the Terms of Use or if there is anything you do not understand, please get in touch with us and we will be happy to answer your questions. Please in particular pay close attention to the Important Note that is directly below and then please read on carefully.

IMPORTANT NOTE: Everything contained in the Terms of Use is important and should be read by you, but we would like to draw your attention in particular to the following clauses in these General Terms and the important terms that they contain. These clauses have the potential seriously to affect your interests. You must read these clauses themselves and not rely on the short summaries below.

  • By registering for an Account, you are entering into a legally binding agreement: To use the Services, you must register and open an Account with us (“Account” is defined in clause 4.1) and, by registering for an Account, you will be entering into a legally binding agreement with us which incorporates all the terms, conditions, policies and documents forming the Terms of Use (See clause 2).
  • You must be at least 18 years of age and meet other requirements to use the Services: You must be 18 years of age or older and meet the other eligibility criteria to use the Services. Underage gambling is a criminal offence in many jurisdictions including the United Kingdom. (See clause 4).
  • We need to complete verification checks before you can do certain things: We will need to complete our verification checks before allowing you to do certain things in connection with your Account, including withdrawing winnings from your Account. If we’re unable to complete our checks to our reasonable satisfaction we will ultimately suspend or close your Account and pass on any necessary information to the relevant authorities (See clause 5).
  • You may only open one Account: You may only register one Account with us. If we discover that you have opened more than one Account, we will have certain rights including the right to close your Account(s)and to void winnings (See clause 6).
  • Withdrawing your funds: You will usually be able to withdraw your available real money balance at any time, but there are certain circumstances in which we will be entitled to delay or withhold withdrawals (See clause 8.7).
  • We will not tolerate fraudulent activity, ‘suspicious betting’ (which we define and explain in clause 11), cheating, or any other “Prohibited Activities” (as defined in clause 10). If you do any of these things, we will have certain rights against you, including (depending on the particular circumstances) suspending or closing your Account, cancelling/voiding your bets, and withholding attributable winnings (See clauses 10, 11 and 12).
  • Maximum payout limits apply to our Services: This means that, regardless of the amount you stake and no matter how much you appear to have ‘won’, you will only be entitled to receive up to the maximum winnings limit. The limits are:
  • In relation to Paddy Power Services: the maximum payout to any one customer in any twenty four hour period (00:00 – 23:59) regardless of size of stake or number of Bets are as set out in the Betting Rules or as specified on the Bet slip, whichever is the lesser sum (see clause 18 for the relevant rules and definitions).
  • In relation to each of Additional Gaming Services (as defined in clause 2.3): other than progressive jackpot slots, the maximum winnings for any one wager or gameplay transaction shall be communicated in the Betting Rules or in the game rules for the applicable game (See clause 18).
  • Errors, Malfunctions, and Interruptions: all our gambling software is tested carefully but computer software and systems are never perfect. Mistakes of odds and pricing can also be made in betting markets. If one of the Services suffers a software error, or presents incorrect information to you such as incorrect terms or winnings, we have the right not to pay you out. This includes circumstances where the problem is not obvious to you and is only discovered by us when we check or verify the result of a transaction. (See clause 19)
  • In certain circumstances, our liability to you is limited or excluded: When you play with us, it is important that you understand what we are liable for, when limits to our liability will apply (and what those limits are), and what we are not liable for. It is also important that you understand that we will not be liable to you under the Terms of Use, and nor do we owe you a duty of care in respect of, our compliance or non-compliance with any regulatory obligations that we may be under from time to time including those relating to so-called ‘safer gambling’ or ‘social responsibility’ (See clause 28).
  • Our right of set-off and your obligation to compensate us: Sometimes we can set off the positive balance in your Account against amounts that you owe to us. You may also be required to compensate us if we suffer losses because you have engaged in a Prohibited Activity. (See clause 29)

General Terms and Conditions

1. Who We Are

1.1 The website www.paddypower.com and its associated Paddy Power-branded websites (together the “Websites”), the Paddy Power mobile apps (together the “Betting Apps”), Paddy Power Dial-a-Bet (“Dial-a-Bet”) and Paddy Power Text Betting (“Text Betting”) are operated and controlled by PPB GE Ltd, PPB Counterparty Services Ltd and PPB Games Ltd, all having their registered office at Triq il-Kappillan Mifsud, St. Venera, SVR 1851, Malta. These companies are wholly owned subsidiaries of Flutter Entertainment plc, an Irish company having its registered office at Belfield Office Park, Beech Hill Road, Clonskeagh, Dublin 4 (Ireland), registered at the Companies Registry Office, Ireland, under the number 16956.

1.2 References in these General Terms to “Paddy Power”, “we”, “us” or “our” are to PPB GE Ltd, PPB Counterparty Services Ltd, and PPB Games Ltd.

1.3 Our licensing arrangements are as follow:

As we made clear in the ‘Important Note’ at the beginning of these General Terms: notwithstanding our regulated status, we will not be liable to you under the Terms of Use, and nor do we owe you a duty of care in respect of, our compliance or non-compliance with any regulatory obligations that we may be under from time to time including those relating to so-called ‘safer gambling’ or ‘social responsibility’.

1.4 Together, the Websites, the Betting Apps, Dial-a-Bet and Text Betting are referred to as the “Paddy Power Services”. Together, the Paddy Power Services and the Additional Gaming Services (as defined in clause 2.3) are referred to as the “Services”.

1.5 Each member of the Flutter Entertainment plc group of companies (the “Paddy Power Group”) is entitled to exercise any of the rights or obligations of any other member of the Paddy Power Group under the Terms of Use.

  • For customers in the United Kingdom, PPB GE Ltd, PPB Counterparty Services Ltd, PPB Entertainment Ltd and PPB Games Ltd are licensed and regulated in Great Britain by the Gambling Commission under account numbers 52819, 39439, 39426 and 39411. PPB GE Ltd is licensed under licence number 052819-R-329340 to provide bingo and casino. PPB Counterparty Services Ltd is licensed under licence number 039439-R-319330 to provide betting on real and virtual events. PPB Entertainment Ltd is licensed under licence number 039426-R-319332 to provide bingo and casino. PPB Games Ltd is licensed under licence number 039411-R-319335 to provide casino and pool betting.
  • PPB Counterparty Services Limited is licensed and regulated by the Malta Gaming Authority to offer Games, Sportsbook, Virtual Games and Tote under license number MGA/CRP/131/2006, issued on 01/08/2018.
  • PPB Counterparty Services Limited also holds a Remote Bookmaker’s Licence in the Republic of Ireland (Licence Ref: 1010107).

2. These General Terms, the Terms of Use, and Your Relationship with Paddy Power

2.1 Not all of the legal terms and conditions that apply between you and us are set out in these General Terms – some of them are contained in separate documents in order to avoid these General Terms becoming too long and cumbersome. We cross-refer to these other documents and provide you with links to them at all appropriate junctures. They are nevertheless important terms which form part of the legal contract between you and us, and you should read and understand them just like the rest of these General Terms. These cross-referenced terms which (together with these General Terms) form the “Terms of Use” include those set out in clause 2.2 and (if applicable) clause 2.3:

2.2 By visiting the Websites and/or by registering for an Account and/or otherwise using or accessing the Services, you agree to and are bound by the following:

2.3 In addition, where you use any of the betting or gaming Services referred to in this clause 2.3 (“Additional Gaming Services”), you also agree to be bound by the terms and conditions associated with each of those Services, as set out and linked-to below (together the “Additional Gaming Terms”):

2.2.1 these General Terms;

2.2.2 the Betting Rules;

2.2.3 the Standard Promotional Terms and any any individual terms and conditions which apply to promotions, bonuses, and special offers which we may offer via the Websites from time to time; and

2.2.4 all such other of our terms and conditions, rules or policies as they relate to any applicable Services (e.g. the rules for a particular game), promotions, bonuses, special offers or any other aspect of your use of the Services from time to time.

2.3.1 Games & Vegas, Live Casino, Bingo, and Poker Additional Gaming Terms (containing additional terms and conditions relating to our Games & Vegas, Live Casino, Bingo, and Poker Services);

2.3.2 Lotto Bets;

2.3.3 Fantasy;

2.3.4 Gaming End User Licence Agreement; and

2.3.5 the terms and conditions of third party service providers where indicated.

3. Amending the Terms of Use

3.1 We may amend the Terms of Use from time to time for a number of reasons including (without limitation) commercial reasons, to comply with law or regulation, to comply with instructions, guidance or recommendations from regulatory bodies, or for customer service reasons (e.g. to keep up to date with any changes to the Services).

3.2 If we make material changes to the Terms of Use, we will give you as much prior notice of such changes as is reasonably practicable but, in any event, customers will be notified of material changes before they come into effect. Material changes will be communicated to you via pop-up web and/or mobile messages when you log into your Account and/or by email. Your continued use of the Services after being notified of the material changes will be deemed to be your agreement to the changes. If you do not agree to the changes, then you must not continue to use the Services, but you will always be able to withdraw your funds (subject to any rights we may have under the Terms of Use to withhold funds).

3.3 The date on which each relevant document comprising the then current Terms of Use came into (or will come into) force will be stated at the bottom of the relevant page(s)

Account Eligibility

4.1 To use the Services, you must register and open an Account (“Account”) with us. In order to register an Account, you agree and warrant (i.e., you promise and confirm to us) that:

4.2 For various legal, regulatory, commercial and/or other reasons, we do not permit Accounts to be opened by persons who are located in certain territories (the “Prohibited Territories”) and we do not permit Accounts to be accessed or operated (either deliberately or accidentally) in those Prohibited Territories. You agree not to bypass any measure we may use to prevent or restrict access to the Services. The Prohibited Territories may be updated by us from time to time, in accordance with clause 3, with or without prior notice to you. The current list of Prohibited Territories can be found here.

4.3 The availability of our Services does not constitute an offer, solicitation or invitation by us for the use of our Services in any jurisdictions in which such use is prohibited by law. The Paddy Power Group shall not be liable for any breach of any local, national, federal, state or other laws that may occur as a result of your using the Services.

  • 4.1.1 you are at least 18 years of age (underage gambling is a criminal offence in certain jurisdictions – please see clause 5.2 below for more information about what happens if we discover that you are underage);4.1.2 you will provide accurate registration information when opening your Account, including without limitation your correct date of birth, together with valid identification proving the same, your country of residence, your current address, email address and personal telephone number. You further agree to promptly inform us of any changes in such details;4.1.3 you acknowledge that you are opening an Account solely for your personal use, and are not acting and will never act on behalf of any third party;4.1.4 you will not attempt to sell or otherwise transfer the benefit of your Account to any third party and nor will you acquire or attempt to acquire an Account which has been opened in the name of a third party;4.1.5 you will comply with your own local, national, federal, state or other laws concerning betting and gaming prior to opening an Account, placing any bets, stakes or wagers (together “Bets”) or using the Services. In particular, if you are located in a country where use of a particular Service is prohibited including any Prohibited Territories (as defined in clause 4.2), you must not (i) register with us for the applicable Service; (ii) attempt to use that Service; or (iii) use your payment card or other payment method to undertake betting or gaming with us by means of the unlawful Service;4.1.6 you are legally capable of entering into binding contracts, including the Terms of Use and each subsequent Bet (which shall be governed by the Terms of Use);4.1.7 you are not prohibited for any reason from betting with us or any member of the Paddy Power Group, or from using the Services or any of the services of any member of the Paddy Power Group;4.1.8 you are not currently subject to a self-exclusion from a Betfair, Paddy Power, Sky Betting and Gaming (which includes Sky Bet, Sky Vegas, Sky Casino, Sky Poker, Sky Lotto and Sky Bingo), Full Tilt Poker or PokerStars account and you have not signed up to a national self-exclusion register (such as GAMSTOP) which excludes you from gambling; and4.1.9 you accept that by using the Services, there is a risk that you may lose money.

Account Verification and Due Diligence

5.1 The following information must be provided during the Account registration process:

5.2 We will verify your age in line with our legal and regulatory requirements in your territory and we may ask for proof of age and/or address from you (and we may suspend or restrict your Account until you provide such evidence). Underage gambling is a criminal offence in certain jurisdictions including Great Britain, Northern Ireland, the Channel Islands and the Isle of Man. If you are located in these jurisdictions, you will not be permitted to gamble until we have verified your name, address and date of birth. If we discover (after you have successfully registered and opened an Account) that you are under 18 years of age, your net losses incurred during the period you were underage will be returned to you, any open bets will be voided, and we may make a report to the relevant regulatory or law enforcement authorities.

5.3 As noted above, you must enter all mandatory information requested into your registration form, all of which must be true, complete and correct. You authorise us to carry out identification, credit and other verification checks that we may require and/or are required by applicable laws and regulations and/or by the relevant regulatory authorities. You agree to provide all requested information in connection with these verification checks.

5.4 We’ll try and conduct our verification processes electronically where possible, but if we are unable to do so, or if the check is inconclusive, we may ask you to provide us with personal identity documents. The identification documents that we may request that you provide to us can be found here. For non-UK customers, identity verification is triggered in line with regulatory requirements and may be required at various stages/upon various triggers including (but not necessarily limited to) on Account registration, at certain deposit levels, and/or based on other risk factors.

5.5 As a licensed gambling operator and in compliance with our legal and regulatory obligations we are required to conduct a number of checks during the whole time that you have an Account with us. In order to meet our regulatory obligations, we may ask that you provide personal details and/or documentation relating to your financial circumstances. 5.6 You agree to provide all such information as we reasonably require, in the form that we require it, from you from time-to-time. If you do not or cannot provide us with the information that we need, we are entitled to restrict your Account in any manner that we reasonably deem appropriate, including preventing you from accessing the Services, placing any Bets, or from withdrawing your funds. Your Account may also ultimately be suspended or permanently closed in accordance with clause 12.

5.7 You accept that all transactions may be checked to prevent money laundering and that any transactions made by you which we deem to be suspicious may be reported to the appropriate authorities.

5.8 When deciding whether to accept your application for an Account, we may supply the information you have given us to authorised third parties to confirm your age, identity and registered payment details. They will check any details we disclose to them against any databases (public or private) to which they have access and will keep a record of that check.

5.9 For regulatory reasons, your session may be timed out as a result of a period of inactivity on your Account. You acknowledge that it is your responsibility not to leave your session unattended/inactive.

5.10 We will process the personal information which you provide in connection with Your registration in accordance with our Privacy Policy.

  • valid mobile number;
  • date of birth;
  • first and last name;
  • full residential address;
  • valid email address; and
  • a chosen password.

Duplicate Accounts
6.1 Only one Account is permitted per customer for all of the Paddy Power Services. If you open more than one Account, each such additional Account will be classified as a “Duplicate Account”. If we discover that you hold one or more Duplicate Accounts, we will (in respect of each Duplicate Account):

6.1.1 close the Duplicate Account(s) or the original Account (as applicable), leaving you with only one Account (unless we have reason – for example if you have deliberately or fraudulently opened more than one active Account – to close all of your Accounts);

6.1.2 treat all bonuses and free bets, and all winnings accrued from such bonuses and free bets, obtained using the Duplicate Account as void; and

6.1.3 void all future bets/wagers made on the Duplicate Account.

Account Security and How Your Funds are Protected

Account Security

7.1 To open an Account, you will need to choose your own confidential username and password (except for Dial-a-Bet, which automatically assigns customers a username).

7.2 Your username and password must be kept confidential. All Bets placed using a correctly entered Account username and password (or such other criteria as may be communicated to you, for example by Dial-a-Bet) will be regarded as valid, provided that:

7.3 Subject to the foregoing and other than where it is due to our negligence, we will not be liable for any loss that you may incur as a result of misuse of usernames or passwords, or from any unauthorised use of your Account, whether fraudulent or otherwise.

7.4 Please contact us as soon as is possible if you have lost or forgotten your Account details. You agree to inform us as soon as possible (by telephone, where possible) if you believe that your Account information is being misused by a third party so that we may suspend your Account to prevent further abuse.

7.5 It is your responsibility to ensure that all your personal details are current and up-to-date, as failure to do so may result in Bets or payments being declined or payments being issued incorrectly. You can update your personal details via the Websites, by chat, by telephone, via Dial-a-Bet or the Betting Apps.

7.6 We recommend that you disable any automatic password memory in your browser prior to using the Services. This will help to limit the risk to you of unauthorised use of your Account.

How Your Funds are Protected

7.7 To Bet or to play for money on Paddy Power you need to deposit funds (see clause 8 for more information about depositing funds). Except as set out in clause 7.9, all funds in customer accounts are held by The Sporting Exchange (Clients) Limited, a group company established solely for the purpose of holding customer funds (the “Trustee”), under the terms of the Trust Deed (the “Trust Fund”). Holding your money in the Trust Fund has the following benefits:

7.8 The arrangement described in the clause above meets the Gambling Commission of Great Britain’s requirements for the protection of customer funds at the level: “high protection”. 7.9 Your funds will not be held by the Trustee if: (i) there is a requirement for such funds to be held under the terms of any of our gambling licences, in a separate non set-off bank account in the name of the licence holder; or (ii) where such funds are deposited via a third party payment provider (hereafter referred to as a “Payment Provider”). Funds deposited via a Payment Provider may take a few days before they are held by the Trustee under the terms of Trust Deed. During this period your funds will be held in the account of the relevant Payment Provider and will not be protected under the terms of the Trust Deed. Depositing by any method other than the following will be classed as a deposit via a third party Payment Provider: (a) bank transfer, (b) cheque, (c) credit card (except for customers from the United Kingdom who may not deposit using credit cards); and (d) debit card.

7.10 We can refuse to register you as an Account holder for any reason and we do not have to explain its decision to you.

7.11 The Paddy Power Group and any third parties it contracts with in relation to the provision of the Services will hold information with respect to your identity, including but not limited to your name, address and payment details, in accordance with our Privacy Policy and our Cookie Policy.

7.2.1 the Bet meets the other criteria for placing a Bet as laid down in the Terms of Use; and

7.2.2 we have no other reason to believe, at the time of acceptance of the Bet, that the Bet was not placed by you.

7.7.1 if Paddy Power (or any other operating company within the Paddy Power Group) becomes subject to any insolvency proceedings, then your money will not be available to administrators/liquidators (or similar) and so you will be able to withdraw your money from your account as normal except where the Terms of Use permit us to withhold funds;

7.7.2 the law of equity (which governs this Trust Fund) provides additional remedies to all beneficiaries of the Trust Fund (i.e., to all Paddy Power customers) that may not otherwise exist in a contractual relationship (e.g., a duty to act in good faith); and

7.7.3 we have a number of additional controls in place over the Trust Fund to protect your money.

Deposits & Withdrawals

Deposits

8.1 To participate in any real-money Bets via the Services, you must deposit monies into your Account.

8.2 Customers can choose which currency is most convenient for them to manage their Account from the following list:

8.3 Once an Account has been opened, the currency cannot subsequently be changed. All deposits and withdrawals shall be processed in the originally selected currency.

8.4 Cheques or bank drafts will only be credited to your Account upon clearance by our bank. Cheques or bank drafts should be made payable to The Sporting Exchange (Clients) Ltd and sent to: Power Tower, Belfield Office Park, Beech Hill Road, Clonskeagh, Dublin 4 (Ireland).

8.5 Please note that minimum and maximum Account deposits apply, as will be indicated to you where relevant. More information can be found here.

8.6 Interest is not payable on Account balances. Credit is not permitted. It is your responsibility to maintain sufficient funds in your Account, and to stake your Bets accordingly. We will void any Bet which has been inadvertently accepted if your Account does not have sufficient funds to cover the whole of the Bet and/or (as applicable) recover the amount of any shortfall.

Withdrawals

8.7 Funds may be withdrawn by you from your Account at any time provided that:

Miscellaneous terms relating to deposits/withdrawals

8.8 We do not charge you for deposits or withdrawals although you should check with your bank and/or other payment service provider as to whether they will impose any charges.

8.9 Please note that you are responsible for reporting or declaring any funds withdrawn, including any winnings, if such reporting is required by local law, tax or other authorities. We are not responsible for any taxes that may be payable by you whether on any Bets, on any winnings or otherwise.

8.10 Any changes to your personal/card details must be advised to us as soon as is possible, as failure to do so may result in your deposit or Bets being declined by your bank.

8.11 As well as informing your bank, please inform us as soon as is possible should your bank card be lost or stolen.

8.12 If you or your bank advise us that your card has been lost or stolen, no further Bets will be accepted on your Account until you contact us with further instructions.

8.13 While we shall take reasonable steps to avoid mistakes, outside of where we are negligent, we cannot accept any responsibility or liability for any errors or omissions in respect of withdrawal of funds or crediting of Accounts. Should funds be debited or credited incorrectly, it is your responsibility to notify us without delay, and we shall endeavour to rectify such error except where the Terms of Use permit us to withhold payment.

8.14 For customers in England, Scotland, Wales, Northern Ireland, Isle of Man, Jersey, and Guernsey: Credit cards are not accepted as a form of deposit or withdrawal payment. References to credit cards elsewhere in these General Terms shall be relevant for all other jurisdictions but not the territories listed in this clause.

8.15 Funds deposited from debit or credit cards will be credited to your Account as soon as is possible on receipt of an authorisation from your bank. It is your obligation to ensure that you keep these funds in your debit or credit card account until your bank deducts them.

8.2.1 Pound Sterling GBP (£); or

8.2.2 Euro EUR (€).

8.7.1 all payments made into your Account have been confirmed as cleared and have not been charged-back, reversed or otherwise cancelled;

8.7.2 we have completed any verification checks to our reasonable satisfaction (see clause 5). Where we have requested information from you to carry out these checks, any delay in providing this information may cause delay when withdrawing funds; and

8.7.3 there is currently no ongoing, or completed, investigation:

  • into suspicious or irregular betting patterns and/or possible instances of event manipulation and/or cheating (see clause 9);
  • into money-laundering or the financing of terrorism, including where we suspect that you have been using the proceeds of crime to gamble with us;
  • into an Error, Malfunction or Interruption involving any aspect of the Services which you have played or participated in (see clause 19); or
  • where we have reasonable grounds to believe you may have engaged in an illegal activity or Prohibited Activity (as defined in clause 10) which would entitle us to withhold funds in accordance with clause 12, and in all these cases you acknowledge and understand that, as we made clear in the ‘Important Note’ at the beginning of these General Terms, we ultimately have the right (depending on the particular circumstances) to void any affected transactions, withhold attributable winnings and (in the case of Prohibited Activities) suspend/close your Account with us, and make appropriate disclosures to the police and other relevant authorities.

Placing Bets

9.1 Customers can only Bet up to the amount held within their Account or allowed by their bank or the limit as set out in the Betting Rules, whichever is the lesser. The minimum and maximum Bet per selection is determined exclusively by us and is detailed on-screen or will be communicated by the telephone operator, where relevant.

9.2 We are entitled to accept or decline the whole or part of any proposed Bet for any reason and we shall have no obligation to explain or give reasons why.

9.3 Bets placed by credit/debit card or any other means do not become valid until we have received payment in full. If payment has not been received before an event commences, then that Bet is automatically void unless we communicate otherwise to you at the time of the attempted placing of the Bet.

9.4 Each Bet will be given an individual number as confirmation of the Bet. Bets will be valid (subject to meeting the criteria for placing a Bet laid down in the Terms of Use) if accepted by the Paddy Power Bet server, whether or not you receive the Bet number and whether or not you have made an error in the Bet that you have placed (for example by placing a Bet in an amount that you did not intend). We are not liable for the settlement of any Bets where we have not issued a written confirmation of acceptance of the Bet or where we are unable to display that Bet in the ‘My Account’ pages of the Websites. It your responsibility to ensure that all of the details of your Bets are correct. Once a Bet has been accepted by the Paddy Power Bet server, that Bet cannot be cancelled by you. If you have any concerns as to whether your Bet has been accepted by the Paddy Power Bet server, please log in and go to the ‘My Account’ pages of the Websites where details of all live Bets entered into by you will be displayed. If you have any further concerns including if you think you may have placed any Bet in error then please contact us immediately.

9.5 You must exercise your own judgement in placing a Bet and you hereby confirm that you have not relied on the advice of any Paddy Power employee relating to any Bet.

9.6 Bets must be made via the Websites, via the Betting Apps, via Dial-a-Bet or via Text Betting.

9.7 Please familiarise yourself with betting and gaming terminology and how the various bets and games made available via the Services are operated. If you have any queries please contact us. Paddy Power cannot accept any responsibility if you place a Bet in circumstances where you do not fully understand any of the terms involved or how the bet or game or event is operated.

9.8 On occasion the prices available across the various Services may not be the same – for example, a price on the Websites may not be the same as those prices available at Paddy Power outlets or on Dial-a-Bet. Paddy Power accepts no liability for the fact that you could have obtained a different price through some other medium.

9.9 Guaranteed prices and other special offers or promotions are available at the discretion of Paddy Power and can be restricted on an individual Account basis at any time.

9.10 With the exception of “Live Betting” events (see clause 13 for Live Betting rules), Bets are accepted up to the off-time of the event, or a pre-determined time, whichever is earlier. We may allow a grace period for some sporting events during which Bets will be accepted, but we are entitled to void any or all Bets if we think (acting reasonably) there has been a significant development in the event prior to placement or purported placement. We can void any Bet if accepted in error after the betting has closed or where the event was resolved or at a stage where the customer could have an indication of the outcome. In such circumstances, we will return the amount you staked on such Bet.

9.11 Not all participants are quoted in every event. However, a price is available for almost all entries or outcomes in any event. If you wish to bet on an unnamed selection, please contact one of our Customer Support agents and we will endeavour to add this selection to the market.

9.12 Paddy Power may, without any requirement to give reasons, exclude any customer from the Services generally or from receiving selected promotions (e.g., guaranteed best price; bonuses; free bets; enhanced prices; and money-back specials) and any other promotions and offers introduced by us from time to time.

9.13 In the event of there being a dispute over the time at which a Bet was placed, or as to whether a Bet has been placed at all, then the time at which it was recorded (if recorded) on the transactional log will govern settlement. If an attempted bet was not recorded on the transactional log, no Bet shall be deemed to have been placed. You should check your Account balance each time you visit the Websites.

9.14 It is a condition of our acceptance of Bets from you, and by offering to place a Bet with us you represent and warrant (i.e., promise and confirm to us) that:

9.15 In the event of a warning being received by us in relation to suspicious or irregular betting patterns and/or possible instances of event manipulation we have the right to:

9.16 Further, in the case of active event manipulation being confirmed as having taken place on any event or series of events (by the appropriate sports governing bodies or by any other means), we have the right to suspend any Bets placed on such events, either by any individual identified as having misused Inside Information (defined in clause 9.18) or by any other individual who in our reasonable opinion is connected to, acting in conjunction with, or in any way involved with such individual or the event manipulation.

9.17 We may refuse or limit any Bets or bonuses (for example by setting minimum and maximum amounts which will be set out in the Betting Rules, or by setting wagering requirements), or change such limits, without any obligation to provide you with notice of such limit or change.

9.18 “Inside Information” means any information which has not been made public and, if it were made public, would be likely to have a material effect on the relevant market relating to the event.

9.19 Employees of any licensor of games on the Websites (or employees of a member of any such licensor’s corporate groups) are not eligible to participate in games supplied by such licensor on the Websites.

9.14.1 you are not prohibited from entering into the Bet by any term of your contract of employment, the Terms of Use, or any rule of a sport governing body or other professional body of which you are a member or which otherwise applies to you;

9.14.2 where the Bet is placed on the outcome of a race, competition or other event or process or on the likelihood of anything occurring or not occurring (“the event”), you do not know the outcome of the event;

9.14.3 you are not misusing Inside Information (as defined in clause 9.18) to place a Bet;

9.14.4 you are not using stolen money (i.e. the ‘proceeds of crime’) to fund your Bets.

9.15.1 suspend our offering on any event, or series of events, in any of our markets; and

9.15.2 delay and/or withhold payment on any event, or series of events, until the integrity of such event, or series of events, has been confirmed:

a. by the relevant sports federation or governing body (where applicable); or

b. by us, acting reasonably.

Prohibited Activities
10.1 You may only use the Services, including your Account, for lawful gambling in accordance with the Terms of Use. You may not engage in any activity which we define below as a “Prohibited Activity” and you acknowledge and understand that the consequences of you doing so, as we made clear in the ‘Important Note’ at the beginning of these General Terms, will (depending on the particular circumstances) include the voiding of any relevant transactions, the withholding of any winnings, and the suspension and/or closure of your Account.

10.2 The following activities are prohibited (each a “Prohibited Activity”):

10.2.1 if the name registered on your Account does not match the name on the financial/bank account and/or the debit (or where permitted, credit) card(s) used to make deposits on that Account;

10.2.2 if you appear, in our reasonable judgement, to be depositing or withdrawing money or otherwise using the Services without genuine play;

10.2.3 if you are located in, or are seeking to access your Account from, any Prohibited Territory, either deliberately or accidentally, including if you are using a VPN to disguise your location;

10.2.4 if we have received a “charge-back” and/or a “return” notification via a deposit mechanism used on your Account;

10.2.5 if you use the Services other than for your personal and recreational use;

10.2.6 if you deposit money into your Account which originates from any illegal activity or any illegal/unauthorised source;

10.2.7 if you provide incorrect or misleading information while registering for an Account (except where you provide any incorrect or misleading information in order to pass relevant age-verification checks, which situation will be dealt with as described in clause 5.2);

10.2.8 if you allow (whether intentionally or unintentionally) someone else to use your Account;

10.2.9 if you have deliberately or fraudulently opened or are using one or more Duplicate Account(s);

10.2.10 if you make or attempt to make a Bet when your Account contains insufficient cleared funds;

10.2.11 if you engage or if we suspect (acting reasonably) that you have engaged in any form of fraudulent or illegal activity, cheating, collusion (including in relation to charge-backs), money laundering, exploitation of Errors, Malfunctions or Interruption, utilisation of software to gain an unfair advantage, suspicious betting (as defined and further explained in clause 11) or any other unlawful or improper activity;

10.2.12 if we discover that you are accessing the Services in contravention of the laws of the country where you are located;

10.2.13 if we suspect (acting reasonably) that your Account’s usage represents ‘business usage’ (‘business usage’ includes any use by a betting operator or any use by an individual or organisation supplying data or services to a betting operator);

10.2.14 if you are prohibited from entering into a Bet by any term of your contract of employment or any rule of a sport governing body or other professional body which applies to you;

10.2.15 if you place a Bet on any sporting match or event in which you take part, or you otherwise break any of the rules or conditions relating to the placing of Bets (including under clause 9);

10.2.16 if you become bankrupt, if you do not make payment of a court judgment on time, if you make an arrangement with your creditors, or if any of your assets are the subject of any form of seizure, or if analogous proceedings are brought in relation to you anywhere in the world;

10.2.17 if we discover or suspect (acting reasonably) that you have breached the terms of any promotion, for instance (but without limitation) if you have opened more than one Account to take advantage of a promotion which was limited to one per customer;

10.2.18 if you engage in any abusive, offensive or otherwise inappropriate behaviour towards other users of our Services (e.g., during gameplay, via our chat functions, etc.) or towards our staff;

10.2.19 if you breach the Terms of Use in some other material or serious way; or

10.2.20 if we become aware that you have played at any other online gambling site (including any site operated by a member of the Paddy Power Group) and, in connection with the same, you are suspected of or have engaged in any of the activities described in this clause 10.2.

Suspicious Betting

11.1 For the purpose of this clause 11, “suspicious betting” means where we have reasonable grounds to believe that a Bet or a number of Bets have been placed in suspicious circumstances. These are the activities that we would consider to be suspicious betting:

11.2 If we discover or have reason to believe that you have participated in any of the activities described in clause 11.1 (which, as stated in clause 10.2, constitute “Prohibited Activities”), we shall have the rights set out in clause 12 below.

11.3 Where a Bet is deemed to be, or is declared, void by us prior to an event, any sum deducted from your Account with respect to that Bet shall be credited to your Account.

11.1.1 where there is an inordinate frequency and/or highly unusual pattern of Bets (by comparison with betting norms) placed on the same selection(s) in a short space of time;

11.1.2 where there is an inordinate frequency and/or highly unusual pattern of Bets placed on the same selection(s) and where the theoretical probability of said selection(s) winning at the time of the Bet(s)’ placement, based on the odds offered on the selection(s) at the time of Bet(s)’ placement, is largely inconsistent with the theoretical probability of the same selection(s) winning, calculated using their accumulated starting prices. By way of illustrative example only, if there was an inordinately large number of Bets placed on a multiple or permutation with combined odds of 250/1 (with a theoretical 0.004% probability of winning based on the odds) and that same multiple or permutation had combined odds of 12/1 based on the Starting Prices of the selections (a theoretical 7.7% probability of winning), this may trigger the suspicions contemplated by this clause 11.1.2;

11.1.3 where the integrity of an event (or events) has been called into question, including, for example, but not limited to where one (or more) of the participants in an event displays exceptional form which we reasonably believe was known to you or someone connected to you at the time of Bet placement but was concealed from the public generally in order to gain an unfair advantage in any Bets placed on that event (or those events);

11.1.4 where we have reasonable grounds to suspect that a Bet or a string of connected Bets have been placed robotically, by automated means, or in some way other than through the Account holder placing each Bet manually via their Account;

11.1.5 where we reasonably believe that you have used unfair external factors or influences connected with the event(s) the subject of any Bet(s);

11.1.6 where we reasonably suspect that you have opened Duplicate Accounts, or where we reasonably suspect that second, subsequent or other purported third-party Accounts are in fact under common control with your Account, with a view to concealing the true worth, nature or pattern of Bets placed by you or on your behalf, even if such second, subsequent or other purported third-party Accounts are opened under different names;

11.1.7 where we otherwise believe, acting reasonably, that you are acting in concert with others or that you are acting other than on your own behalf;

11.1.8 where we reasonably believe that Bets have been placed from a location or device other than the location or device which you claim to have used to place a Bet; or

11.1.9 where we identify a pattern of Bets that have been placed in quick succession by different or the same Account holder(s) that have a combined liability which exceeds what we would expect to accrue on similar Bets during a particular time period based on long term established betting trends. For example, we would regard a series of Bets placed on the same or similar selections in quick succession after 9:30pm and before 8:00am by different accounts with a combined liability that exceeds £100,000 as suspicious, as this conflicts with our long term established betting trends.

Suspension or Termination of Your Account by Us

12.1 If we have reasonable grounds to suspect that you have engaged in any Prohibited Activity, we may suspend your Account without notification, and your Account will remain suspended while the matter is investigated. You agree to cooperate fully with any such investigation. Your funds cannot be accessed or withdrawn during periods of suspension, and any balance will remain in the Account. We may also make a report to the relevant regulatory or law enforcement authorities.

12.2 If our investigation results in our decision (acting reasonably) that the issue has been resolved to our satisfaction, we will lift the Account suspension. If our investigation results in our decision (acting reasonably) that you have engaged in any Prohibited Activity, we will restrict or permanently close your Account. In these circumstances, your details may be passed on to any applicable regulatory or law enforcement authorities or any other relevant external third parties.

12.3 We may also from time to time be required by a competent authority to restrict, suspend or close Accounts for legal or regulatory reasons. Such restrictions, if applicable, may affect your use of your Account.

12.4 We are also entitled to close your Account at any time for any reason (and without the obligation to provide a reason) by giving you no less than 14 days’ written notice.

12.5 Any balance in your Account at the time of any closure by us will be paid back to you, except that:

12.5.1 if you have engaged in illegal activity, we are under no obligation to refund to you any money that may be in your Account; and

12.5.2 if we discover or determine (acting reasonably) that you have participated in any Prohibited Activities then we will void any affected transactions/Bets/string of connected Bets, withhold all or part of your Account balance, recover from your Account deposits, pay-outs, bonuses and/or any winnings (if/as applicable) that are attributable to those Prohibited Activities and/or take any other action that we deem necessary. If you have withdrawn any sums which are attributable to Prohibited Activities, such sums shall be deemed to be held by you on trust for us and shall be immediately repaid to us when a demand for payment is made by us to you.

Live Betting & Cash Out

13.1 Live Betting (or Betting in Running) means betting that takes place while an event is in progress. In addition to the rest of the Terms of Use, the following rules apply to Live Betting:

13.2 Please note that in the case of Live Betting, you may not at any time be able to see or otherwise be provided with the most up-to-date information in relation to the relevant event, including for example (but without limitation), through delayed coverage, a slow connection (i.e. latency) or equipment, or other Errors, Malfunctions or Interruptions (see clause 19). We shall not be liable for any delay in relaying up-to-date information.

13.3 In addition to the rest of these terms relating to Live Betting (which apply equally to our Cash Out functionality), the rules relating to the Cash Out feature are further described here. Please note in particular that for a variety of reasons (including, for example, Errors, Malfunctions or Interruptions, suspicions of fraud, the suspicion of other Prohibited Activities and/or other issues outside of our control), Paddy Power cannot guarantee the availability at all times of the Cash Out functionality, even where the functionality has been advertised in connection with a particular event. Please be aware and accept, therefore, that unless Cash Out is available and successfully exercised in connection with a particular Bet, your initial Bet will, unless otherwise provided in accordance with the Terms of Use, stand as originally placed.

13.1.1 we are entitled to void any part of any, or all, Bets on any Live Betting event that is not completed (i.e. abandoned, postponed);

13.1.2 where an error (including a so-called ‘palpable’, ‘obvious’ or ‘blatant’ error, for example where the price being displayed is materially/significantly different from those available in the general market and/or the price is clearly incorrect, depending on all of the circumstances) is made in offers made, prices offered or Bets accepted or in the transmission of any event on which we have purported to offer Live Betting, Bets may be settled at the correct price at the time at which the Bet was placed, as determined by us; or

13.1.3 where we have reasonable grounds to believe that a Bet is placed after the outcome of an event is known, we are entitled to void the Bet.

Gaming

14.1 Certain games involve peer-to-peer events via the Websites where you will be playing against other customers. Please note that we cannot control certain actions of those customers, who may be for example undertaking fraudulent activities such as colluding with other third parties or using unfair external factors or influences. If you suspect a third party is colluding, cheating or undertaking a fraudulent activity, please let us know as soon as possible. We will take reasonable steps to prevent such unacceptable behaviour. However, we will not be liable for any loss or damage which you may incur as a result of such third party collusion, fraud, cheating or otherwise illegal activity.

14.2 This clause 14.2 applies specifically to games which are tested by us or on our behalf and which use Random Number Generators (“RNGs”) to determine their outcomes:

14.2.1 The Return To Player (“RTP”) percentage represents the theoretical payback made by the game over time, expressed as a percentage of total amounts staked. For certain games offered by us, this theoretical payback percentage is verified by running a large number of transactions – typically in the range of 10 million – through the game to ensure that the expected payback is within an expected range of the theoretical RTP. For those games, the result is generated by an RNG, which guarantees that each game outcome is generated independently and entirely randomly.

14.2.2 Both the testing of the RTP and the RNG are completed by an independent, accredited testing house who perform certification testing on behalf of the appropriate licensing body for each game. In the event of a discrepancy between the results displayed on your computer and a game’s records on our server, our records shall be regarded as definitive.

14.2.3 Details of the RTP percentages which are relevant to each of Paddy Power’s applicable games are included on each game’s information page.

14.2.4 For the avoidance of doubt, Paddy Power does not guarantee that any of the games it offers will pay out according to its RTP percentage in a single hand, spin or play (or, indeed, to an individual customer).

Dial-a-Bet

15.1 In addition to the rest of the Terms of Use, the following rules apply to Dial-a-Bet.

15.2 When registering your Account for the first time with Dial-a-Bet, please follow the operator’s instructions carefully.

15.3 Withdrawal Options: By using your Dial-a-Bet Account number as the username to log in to the Websites, you can view your Bets online and withdraw your winnings at your convenience. Alternatively, you can call our Customer Support department at any time on UK 08000 565 275 or IRL 1800 238 888 to request a statement or request payment of winnings. If the options above are unsuitable, please contact our Customer Support department to make alternative arrangements.

15.4 Bank Authorisation: Your first Bet is debited directly from your debit card or credit card and any winnings that accrue will be credited to your Dial-a-Bet Account. Future Bets will be debited from your Dial-a-Bet Account balance until there are insufficient funds available, upon which, we shall debit your card. It is our policy to seek authorisation at the time the Bet is requested and customers are required to remain on the call until authorisation has been confirmed. Occasionally, we are unable to get a decision before the “Off” of a race/event, and in such circumstances we may accept the Bet subject to bank authorisation being obtained. In the event of our accepting a Bet in these circumstances and authorisation being declined by your bank, the Bet will be void, win or lose.

15.5 Security: In the interests of security and to resolve queries or disputes, all calls to Dial-a-Bet are recorded.

15.6 Bet Confirmation: Minimum and maximum stakes apply, as will be indicated to you where relevant. Your instructions will be repeated back to you during the call – please take care to ensure the Dial-a-Bet agent has correctly interpreted them. At the end of the call you will be asked to confirm that our understanding of your Bet, including the total stake, is correct. All Bets will stand in accordance with your confirmed instructions. Should you wish to have your Bet(s) repeated to you in its (their) entirety this can be requested from the telephonist at the time of Bet placement. Currently our minimum stake per call is £10 or €10; maximum stakes may also apply and you will be informed of this where relevant.

15.7 Disconnection: Should your call be disconnected prematurely, you should ring back as soon as possible to confirm if your Bet has been accepted. The Bet will stand provided we are satisfied that your instructions are clear; that they are acceptable by our trading department; and there being sufficient funds available to place the Bet.

Text Betting

16.1 In addition to the rest of the Terms of Use, the following rules apply to Text Betting.

16.2 You must have registered an Account to use Text Betting. You cannot register an Account via Text Betting. Only the mobile phone number registered with your Account may be used to place Bets via Text Betting.

16.3 Where we receive an offer to place a Bet from the mobile phone number associated with your Account, we may at our discretion, and subject to the rest of this Section 16 and the Terms of Use, accept that Bet.

16.4 A Bet shall not automatically be deemed to be valid by your sending an offer to Bet to us in connection with your Account. As with any other electronic communication, for reasons outside of our (or your) control, we may not receive your offer to place a Bet on time (or at all). Also, we may decline an offer by you to place a Bet and we do not have to give you reasons for our decision. Bets will be valid only if accepted by the Paddy Power Bet Server, which will be conclusive as to acceptance or otherwise. We will endeavour to send confirmation of Text Bets by sending a Bet Receipt but again we cannot guarantee delivery or receipt by you of a Bet Receipt.

16.5 We may restrict or place limitations on customers using Text Betting or to limit the amount of any Bet, including, for example, by way of individual Bet limits, daily limits, or individual customer limits, without any obligation to give you notice of our decision.

16.6 By using Text Betting, you will receive customer service communications from us to enable us to respond with Bet Receipts and/or deal with any queries. If you would also like to receive marketing communications about Text Betting, you will need to text the words GIVE ME OFFERS to 51465. If you wish to unsubscribe from marketing communications about Text Betting you can simply text the word STOP to 51465 at any time.

16.7 It is your responsibility to ensure the security of your mobile phone. Other than where we have been negligent, we will not be liable for any loss that you may incur as a result of misuse or unauthorised use of your mobile phone number or Account, whether fraudulent or otherwise.

Betting Apps

17.1 In addition to the rest of the Terms of Use, the following terms and conditions apply to the Betting Apps.

17.2 You accept that using the Betting Apps outside of a WiFi network may result in data charges from your mobile network provider. Paddy Power will not be responsible for any data charges incurred as a result of your using the Betting Apps.

17.3 If you suffer a disconnection, latency, or you exit the application for any reason during a game where a further player action is required, then this game will be resumed from this point when you log back in to the application and launch the relevant game. If you have a winning hand(s)/game and are disconnected prior to being able to ‘gamble’ on a video, poker or slot game, your winnings will be credited to your Account and you will not have the option to gamble when you reconnect. If no further decisions or action are required in an individual game following disconnection/exit, for example after the wheel spin has commenced in a roulette game, then the game will be settled and the result displayed in your Account history.

17.4 Game rules for individual games can be found within the Betting Apps and on the applicable Websites.

Winnings & Payment

18.1 All cleared winnings will be credited to the customer’s Account except where the Terms of Use permit us to withhold winnings. Where a debit or credit card was used to make the initial deposit, all payments made to a customer as part of a withdrawal of funds will be made to the same debit or credit card used to deposit. In the event that this is not possible, payments will be made by cheque, bank transfer or cash in accordance with the personal details stored in the customer’s Account.

18.2 Please note that your bank can take up to 5 working days to return withdrawals to your debit or credit card. Our default method of payment is to return funds directly to the debit or credit card used to make the deposit. Cash withdrawals may be subject to certain criteria, for example payment of winnings will be made by bank transfer or cash upon request and will be sent to the address registered on the Account. Please see clause 8 for further details about deposits/withdrawals.

18.3 Results of sports events/matches and ancillary markets will be as published and confirmed by the Press Association (to the extent applicable) or as otherwise generally accepted.

Winnings Limits

18.4 As we made clear in the ‘Important Note’ at the beginning of these General Terms, maximum winnings limits apply to our Services and these limits apply regardless of stake. The maximum winnings for each Account shall be as follows:

18.5 Paddy Power will try to ensure that Bets which could result in potential winnings which will exceed the maximum payout limit for a particular event/market will not be accepted. However, due to technical limitations, it is not always possible to prevent such bets from being accepted in error. As maximum payout limits vary depending on the particular sport and event type, we strongly encourage all customers to check the limits set out in the Betting Rules before placing their bets, particularly if the potential winnings (i.e., absent the maximum winnings limit) would be in excess of £/€1,000. As we made clear in the ‘Important Note’ at the beginning of these General Terms, you will only be entitled to receive up to the maximum winnings limit regardless of the amount of your stake and no matter how much you appear to have ‘won’.

18.4.1 with respect to Paddy Power Services or any sports betting transactions placed through the Services: the maximum payout to any one customer in any twenty four hour period regardless of size of stake or number of Bets are as set out in the Betting Rules or as specified on the Bet slip, whichever is the lesser sum. Currency equivalent maximum payouts will apply for any currency not listed in the Betting Rules.

18.4.2 with respect to the Additional Gaming Services: the maximum winnings for any one wager or gameplay transaction shall be as set out in the applicable Additional Gaming Terms or in the Game Rules for the applicable game.

Nothing in this clause will limit a customer’s ability to win the full amount of any gaming jackpot on Paddy Power except where the Terms of Use permit us to withhold payment.

Errors, Malfunctions and Interruptions

19.1 Paddy Power makes every effort to ensure that no errors are made in prices offered or Bets accepted. However, human and/or systems error may occasionally result in errors.

19.2 In this clause 19 we set out a description of the things that can go wrong and the rights that we have in such events. You should be aware however that this clause does not override or cancel out any rights that you may have under consumer laws and regulations and we do not intend that they should.

19.3 Below are some key definitions to help you understand this clause:

A “Malfunction” refers to where an automated process fails to operate as designed or intended, for example where a piece of computer software produces a deviation from its intended performance specifications or parameters, or where two pieces of software fail to interface or communicate with each other in the manner intended or designed, in either case so as to produce a result which is not the result that was intended or designed. These malfunctions may or may not be apparent to us or to You and they may only come to light as and when settlement instructions, game outcomes, winnings or cashouts are investigated and analysed retrospectively.

An “Error” refers to a mistake or error that is not exclusively technical, for example the mistaken posting of incorrect odds, the offer of incorrect prices or terms for participation in a promotion or gambling opportunity. Errors can arise from human mistakes, administrative, operational or systems failures and combinations of all of these. For example, a bet might be offered mistakenly at a price that is substantially out of the market, or “each way” is offered in a market when the pricing of the market clearly indicates that it should have been “win only”, or a promotion designed to offer a £5 return might mistakenly advertise a £50 return or the pay-tables advertised for a product may mistakenly fail to reflect the true payment configuration of the product.

An “Interruption” refers to an interruption in a gambling transaction for any reason, for example an interruption caused by the failure of the internet or connectivity, or severe latency in communications, or technical failure due to some disaster or unforeseen event.

19.4 Where any of the above occur, we will deal with them as described below and it is important that you understand and agree to the following before you use the Services, as we made clear in the ‘Important Note’ at the top of these General Terms.

Malfunctions

19.5 If as a result of a Malfunction, your Account is credited with winnings that you would not have received were it not for that Malfunction, we will have the right to void the relevant transaction and withhold the relevant winnings. This applies even if the relevant gambling product could have produced the same or similar amount of winnings without the intervention of the Malfunction and it applies whether the Malfunction was apparent to you or to us or not. If we have paid out on any such Bets or gaming activities and/or if you have withdrawn any such winnings, such amounts shall be deemed to be held by you on trust for us and shall be immediately repaid to us when a demand for payment is made by us to you.

19.6 Where any Malfunction is or becomes apparent or obvious to you or you suspect that a Malfunction may be occurring, you agree that you will cease your use of the relevant Service(s) immediately, and will report it to us immediately.

Errors

19.7 In the event of an Error, the same applies as for Malfunctions, as set out above. For sports betting markets only, in the case of any errors in prices transmitted (including so-called ‘palpable’, ‘obvious’, or ‘blatant’ errors, for example where the price being displayed is materially/significantly different from those available in the general market and/or the price is clearly incorrect, depending on all of the circumstances), Paddy Power may settle Bets at the correct price at the time of acceptance (or the Starting Price in the case of horse-racing, whichever is the greater).

19.8 Where any Error is or becomes apparent or obvious to you or you suspect that an Error may be occurring, you agree that you will cease your use of the relevant Service(s) immediately, and will report it to us immediately.

Interruptions

19.9 Our priority is to ensure that we deal with Interruptions in a way that is fair and does not systematically disadvantage our customers.

19.10 In relation to betting: we are entitled to suspend betting markets, void bets and return stakes to customers.

19.11 In relation to gaming:

  • where an Interruption occurs after we receive notification of your gamble and where you can have no further influence on the outcome of the event or gamble, the results of the gamble will stand;
  • where an Interruption to a single-participant single stage event occurs before an outcome has been generated we will return your stake to your Account;
  • for games where there are multiple stages or decision points we will take all reasonable steps to restore the game to its last known state prior to the Interruption to enable you to complete the game;
  • for games with multiple participants (equal chance or otherwise) we will deal with these as seems fairest to us (acting reasonably) on a case-by-case basis; and
  • for games that are progressive jackpots, progressive jackpot values will be restored to their pre-failure state to the extent it is within our control and not the games provider.

Self-Exclusion

20.3 Paddy Power provides a self-exclusion facility to help you if you feel that you are not in control of your gambling or if, for any other reason, you wish to stop gambling. To this end, we may retain such personal data as is necessary (and for as long as is necessary, which may be indefinitely) to implement the self-exclusion facility, including for example your name, address and credit/debit card details.

20.4 Our self-exclusion facility involves a joint commitment between us and you. We will take reasonable steps to prevent you re-opening your Account or opening a new Account but you must not attempt to re-open your Account or to try and open new Accounts. You agree that: (i) if you hold accounts with both Paddy Power and Betfair, Sky Betting and Gaming, and/or PokerStars and have self-excluded from any of these sites, you will not access any account which you hold on any of these sites (and we are entitled to prevent you from attempting to access such other sites, including by excluding you from gambling on the other sites); and (ii) if you hold an account with either Paddy Power or Betfair, Sky Betting and Gaming, and/or PokerStars and have self-excluded from any of these sites, you will not attempt to register an account with any of these sites during your period of self-exclusion (and we are entitled to prevent you from registering an account with such other sites). We shall not be liable for any losses you or any third party may suffer if you circumvent our self-exclusion procedures and continue to use our Services or if you continue to gamble with any Paddy Power Group business or third party. You will inform us as soon as you become aware of any errors in respect of your self-exclusion or any other safer gambling mechanisms that we make available to you.

20.5 Self-excluding from Paddy Power will not affect your marketing preferences with third parties, including with advertising websites or other third party affiliates. We strongly recommend that you also consider self-exclusion from third party gambling opportunities and that you consider registering with GAMSTOP (see further below) in order to self-exclude from all gambling opportunities.

Self-exclusion and Betfair Accounts

However, there may be circumstances (including where we are unable to link your Paddy Power account to your Betfair account) where we are unable to do so. For certainty, we therefore recommend that, where you apply a self-exclusion to your Paddy Power account, you also do so to your Betfair account (and any other online account which you hold). To request a self-exclusion for your Betfair account, please either contact the Betfair Customer Services or please visit the ‘Safer Gambling Tools’ page which is available in the ‘My Account’ section of the Betfair website.

20.8 Please note that, if you applied a self-exclusion to your Paddy Power account before 30 December 2016, we will not automatically take steps to apply that self-exclusion to your Betfair account. In these circumstances, we recommend that you separately seek a self-exclusion to your Betfair account (and any other online account which you hold). If you applied a self-exclusion to your Paddy Power account before 30 December 2016 and also wish to self-exclude from your Betfair account, you can do so via your online Betfair account or, alternatively, by contacting our customer services.

Self-exclusion and other accounts

20.9 If you choose to self-exclude from and including 8 June 2022 (the “Commencement Date”) with Paddy Power, Betfair, Sky Betting and Gaming and/or PokerStars on all products by way of an all-product self-exclusion, the self-exclusion will be replicated on any other accounts you hold with the above operators, without any further reference to you, providing we can match the account details with those on the self-excluded account. Where you are self-excluded with one of the above brands and an account with another operator is matched or registered after the Commencement Date, any active self-exclusion (including those placed before the Commencement Date) will be replicated at that stage. Should you believe that your account has been incorrectly matched resulting in an erroneously applied self-exclusion, please contact our customer service team. In any event, we recommend that you separately seek a self-exclusion to any account(s) you hold with these operators. Please note that this clause does not apply to Sky Betting and Gaming customers and PokerStars customers based outside of the United Kingdom, Gibraltar, Guernsey, Isle of Man and British Oversees Territories. Any self-exclusion applied to Paddy Power and Betfair accounts outside of the United Kingdom, Gibraltar, Guernsey, Isle of Man and British Oversees Territories will not be replicated on Sky Betting and Gaming and PokerStars accounts.

Self-exclusion and The Stars Group accounts

20.10 On 5 May 2020 (the “Merger Date”), Paddy Power’s parent company merged with The Stars Group which operates as Sky Betting and Gaming (which includes Sky Bet, Sky Vegas, Sky Casino, Sky Poker, Sky Lotto and Sky Bingo), Full Tilt Poker and PokerStars (together the “TSG Brands”).

Safer Gambling Tools

20.13 If you apply any safer gambling tools (e.g. Deposit Limit, Product Exclusion, Reality Check) to your Paddy Power Account, we are not yet able to apply the same safer gambling tool(s) to your accounts with Betfair, Sky Betting and Gaming, Full Tilt Poker, Paddy Power Retail or Poker Stars, nor will we apply a Full Exclusion (as defined in clause 20.7) and we recommend that you separately seek to apply those safer gambling tools (or their equivalent) to any other online account which you hold (including your Betfair, Sky Betting and Gaming, Full Tilt Poker or PokerStars account). For the avoidance of doubt, you must apply a self-exclusion to your entire Paddy Power account to initiate a Full Exclusion.

Inactive Accounts

21.1 Where a Paddy Power customer account has been inactive for a period of 12 consecutive months, you will be notified by email.

21.2 Following a further month of inactivity, we will deem your account inactive and will attempt to return any outstanding real money balance to you using the last payment method used by you to deposit into the Account, except where the Terms of Use permit us to withhold payment.

21.3 Funds in inactive accounts may be reclassified by us for internal accounting purposes but this will be without prejudice your rights to those funds and there will be no reduction in the protection of those funds as per our player deposit protection arrangements.

21.4 If we choose to reclassify the funds in your inactive account we will first contact you, at least 30 days beforehand, to advise you of your balance, and that you still have a right to access your funds and how you can do this.

21.5 Paddy Power do not charge any inactive account fees.

Closing Your Own Account

22.1 You may close your Account at any time. More information about how you can close your Account can be found on our help pages here.

Software and Downloads

For certain of our Services, it may be necessary to download or otherwise use certain software, including software provided by third parties. In such circumstances, you may be required to enter into an end user licence agreement (“EULA”) in respect of such software. You agree to be bound by the terms of any such agreement. You also agree not to interfere with, modify, decompile, copy, or reverse-engineer any software provided to you as part of the Services except as expressly permitted herein, in the EULA, or as permitted by law.

Hacking and Interference in our systems

24.1 You agree that you must not for any reason, deliberately or otherwise, interrupt, corrupt or exploit for any purposes not intended by Paddy Power any of the Services, including for example by:

24.1.1 attempting to gain unauthorised access to any of the Services, the servers on which the Services are hosted, or any server, computer or database connected to the Services;

24.1.2 using any features which may affect the function or performance of the Services in any way for example (but not limited to) releasing viruses, worms, trojans or similar material that may be malicious or harmful;

24.1.3 the use of automated software (so-called “bots”) to gamble;

24.1.4 interfering or tampering with, removing or otherwise altering in any way, any information in any form which is included in or on any of the Services; or

24.1.5 attacking the Services via a denial-of-service attack or any other form of attack or interference.

User Generated Content

25.1 Certain of the Services may invite or permit you to upload your own content (“User Generated Content”). Paddy Power does not exercise editorial control over, and therefore does not endorse any, User Generated Content, and we shall not be liable in relation to such User Generated Content. You understand and agree that you are solely responsible for your User Generated Content.

25.2 For any User Generated Content you provide, you agree to ensure that such content:

25.3 If you have any issues with User Generated Content provided by any other customer or if you would like to discuss our use (or non-use) of your User Generated Content, please let us know by contacting us at the details below. We are entitled (but are not obliged) to edit or remove User Generated Content for any reason.

25.2.1 is an original work created by you, or you that have a licence or the express consent of the owner to use the User Generated Content, in that manner;

25.2.2 does not infringe any third party intellectual property rights or privacy rights anywhere in the world;

25.2.3 does not contain any defamatory or otherwise inappropriate materials or statements, for example that is hateful or discriminatory on grounds of religion, race, ethnicity, sexual orientation or gender, or which promotes violence;

25.2.4 does not contain any form of malicious computer code (e.g. viruses, bugs, trojan horses etc.) which could disable or disrupt any of the Services;

25.2.5 complies with all applicable laws and regulations; and

25.2.6 may be used in connection with publicising and promoting Paddy Power and its Services.

Your Personal Data

It is your responsibility to ensure that personal information relating to you is kept up-to-date. We will process information about you in accordance with our Privacy Policy and our Cookie Policy.

No Warranty

The Services are provided on an ‘as is’ and ‘as available’ basis. Whilst we use reasonable efforts to ensure that our Services run smoothly, we cannot promise that the Services will be free from errors or omissions nor that they will be available uninterrupted and/or in a fully operating condition. We refer you to Clause 19 for more information about Errors, Interruptions and Malfunctions.

Liability

28.1 Nothing in the Terms of Use is intended to, or will, exclude or limit our liability for:

28.2 As we made clear in the ‘Important Note’ at the beginning of these General Terms, we will not be liable to You under the Terms of Use, and nor do we owe You a duty of care in respect of, our compliance or non-compliance with any regulatory obligations that we may be under from time to time, including those relating to so-called ‘safer gambling’ or ‘social responsibility’.

28.3 Subject always to the paragraphs above in this clause 28, we will not be liable under the Terms of Use for: (a) any loss that could not have been reasonably expected by you and us at the time you register for an Account, or at the time you enter into a transaction for Services (such as any loss of income, business or profits or any information which is lost or corrupted); or (b), separately, for any other damage or loss which is deemed or alleged to have arisen out of or in connection with your use of the Services. In particular, we will not be liable for any damage or loss suffered or incurred by you as a result of:

28.4 Subject always to paragraphs above in this clause 28 and save in respect of any winnings due to you in accordance with the Terms of Use (noting in particular our right to cancel/void winnings in the event of Errors, Malfunctions or Interruptions (see clause 19), the maximum winnings limits described in clause 18), and our right to withhold funds in certain circumstances including under clause 8.7), our maximum liability to you under the Terms of Use in relation to any one incident or series of related incidents is limited to the greater of:

28.1.1 death or personal injury resulting from our negligence;

28.1.2 fraud or fraudulent misrepresentation;

28.1.3 breach of your statutory rights as a consumer, or

28.1.4 for any other liability which we may not limit or exclude under applicable law.

28.3.1 the accuracy, completeness or currency (or lack thereof) of any information services provided by us or third parties (including but not limited to prices, runners, times, results, live scores or general statistics) or any other Error, Malfunction or Interruption;

28.3.2 our closure or suspension of your Account in accordance with these General Terms; or

28.3.3 any use by you of the Services in breach of the Terms of Use (including any Prohibited Activity on Your part).

28.4.1 where such liability relates to a specific Bet, the amount of the applicable stake made by you in respect of such Bet; or

28.4.2 £10,000.

Your Responsibility to Compensate Us

29.1 We may at any time set off any amount on deposit in your Account against any amounts owed by you to Paddy Power.

29.2 You agree to compensate us for any costs, charges or losses sustained or incurred by us arising from any Prohibited Activities on your part.

Intellectual Property Rights

30.1 Paddy Power is the owner or authorised user or licensee of all the intellectual property rights in the Services and their content including, without limitation, any copyright, patent, designs (registered or unregistered), trade marks, service marks, source codes, specifications, templates, graphics, logos or any right in respect of content, databases, formats, interfaces, programming, the offering of services to other customers, software or any application for any of the foregoing and any modification, improvements, developments and enhancements thereof. Except as expressly provided herein, Paddy Power does not grant any express or implied right to you in any of its intellectual property rights or secret information.

30.2 All content and material on the Websites or otherwise accessible via the Services is provided for your own personal (i.e., not for business) usage only. The distribution, reproduction or commercial exploitation of such content and material in any manner whatsoever without our express written consent is prohibited.

30.3 For the avoidance of any doubt you may use the data available from the Websites and the other Services (including for example odds, both live and historical) only as strictly required for your permitted personal, non-exclusive, non-sublicensable, non-commercial purpose of using the Services. Any other use and/or reproduction of the data without prior written consent of Paddy Power is prohibited and will constitute a breach of these Terms of Use. Paddy Power reserves its right to take such action as it considers necessary, including issuing legal proceedings without further notice to you, in relation to any unauthorised use of its data or of the Websites or Services.

Video Coverage of UK Horse Races

30.4 The live linear audio-visual coverage of UK horse races and related audio commentary distributed via broadband internet streaming made available on the Websites (the “Footage”) is owned by Racing UK Limited (“Racing UK”) and licensed to The Betting Site Limited (“TBS”). Racing UK shall remain the exclusive legal and beneficial owner of all copyright and intellectual property rights in the Footage in perpetuity. All rights not explicitly granted herein are reserved by Racing UK and TBS.

30.5 You may view the Footage once on a personal computer screen for personal, private, domestic, non-commercial uses only in accordance with these terms and conditions. You shall not:

30.6 Each of or all of Racing UK, TBS and Trinity Mirror PLC and its group companies may enforce any provision of these terms and conditions against you in the name of Paddy Power.

Bet and Watch Service

30.7 Use of the bet and watch service (“B&W Service”) is subject to the following additional terms and conditions:

30.8 Access to the B&W Service may be suspended at any time at Paddy Power’s discretion.

30.9 The content of the B&W Service is protected by copyright – © Attheraces Limited.

Player Statistics

30.10 Pre-play player statistics are provided by third parties and are not based on live data. While Paddy Power and our third-party providers will endeavour to keep this information up to date you should be aware this data may be subject to a time delay and/or be inaccurate. If you rely on this data to place bets, you do so entirely at your own risk. The Paddy Power Rules for bet settlement still apply and as such we accept no liability for any discrepancies between the information displayed about the players and how a bet is settled. Paddy Power accepts no responsibility for any loss suffered by you as a result of your reliance on these statistics.

30.5.1 make the Footage available to anyone else;

30.5.2 use or view the Footage other than as expressly permitted by these terms and conditions, or copy, relay, broadcast, or communicate the Footage to the public, nor may you include any portion of or all of the Footage in any equipment or item save as specifically permitted under these terms and conditions or develop any improvement or derivative works of any part or all of the Footage;

30.5.3 save, edit, copy, amend, distort, modify, distribute, reformat, disassemble, delay or repeat the Footage and/or its transmission or do anything that is contrary to any of the moral rights or other rights of the copyright owner of the Footage;

30.5.4 remove any product identification (including but not limited to screen icons), legend or notice, or any proprietary or copyright notice from any part of the Footage;

30.5.5 represent or claim that you own any part or all of the Footage or otherwise do anything that is inconsistent with TBS’ and/or Racing UK’s rights in the Footage;

30.5.6 store or transmit any Footage to any publication, user group, other website, electronic bulletin board, mailing list, server or other storage device in any form;

30.5.7 sell or commercially exploit any part or all of the Footage in any way.

30.7.1 access to the B&W Service is prohibited in betting premises;

30.7.2 there shall be no reproduction, distribution or publication of the B&W Service or any content or data contained therein;

30.7.3 the B&W Service may only be used by persons who are resident in the UK/Ireland;

30.7.4 users are responsible for making sure that they have all the equipment and software necessary to access the B&W Service;

30.7.5 no liability for Attheraces Limited (or its sub-contractors) in connection with the B&W Service.

General

31.1 Third Party Linking:

31.3 Severability: If any provision of the Terms of Use is held to be invalid, void or unenforceable by any competent authority, that provision will be, to the extent strictly necessary, severed from the remaining Terms of Use and that determination shall not affect the validity of the remaining provisions of the Terms of Use. In the case of the severance of any terms, the part deemed invalid or unenforceable shall be amended in a manner consistent with the applicable law to reflect, as closely as possible, the original intent in the Terms of Use.

31.4 Waiver: No failure or delay by Paddy Power in exercising any right under the Terms of Use will operate as a waiver of this right. Similarly, any single or partial exercise of any right shall not preclude any further exercise of any of such right or the exercise of any other right.

31.5 Notices: Notices and other communications delivered or mailed to the postal address or to the email address provided by you shall, until we have received notice in writing of any different address, be deemed to have been personally delivered once sent whether actually received or not.

31.6 Interpretation: In the event of there being any conflict or inconsistency between the terms and conditions comprising these Terms of Use, the order of precedence shall be as follows:

31.7 Entire Agreement: The Terms of Use and all the documents referred to and incorporated in them represent the entire agreement between Paddy Power and you and supersede any prior agreement, understanding or arrangement, whether oral or in writing. We each acknowledge that we have not relied on any representation, undertaking or promise given by the other or implied from anything said or written in negotiations between us except as expressly stated in the Terms of Use.

31.8 English Language Version: These General Terms have been prepared in various languages other than English for translation purposes. In the event of any differences between the English version and any other translated version, the version most beneficial to the customer shall prevail.

31.1.1 At Paddy Power’s discretion, the Websites’ or other Services may contain links to third party websites. These links are provided solely as a convenience to you and not as an endorsement by Paddy Power of the contents on such third party websites or any products or services available via them. Paddy Power is not responsible for the content/products/services of linked third party sites and does not make any representations regarding the content or accuracy of materials on such third party sites.

31.1.2 Paddy Power generally welcomes the hyper-linking to the Websites from other websites which we consider to be appropriate, provided such links are to our homepage (and no deeper within the Websites) and provided Paddy Power gives its written consent to the establishment of such links, which consent it may give or deny in its discretion. Any links to the Websites from another website must be presented in such a manner that the viewing of the Websites is not impaired by framing or similar techniques that may impair a browser’s experience.

31.1.3 Paddy Power does not permit linking from the Websites or Services to third party websites or services or the display of third party content on top of, or in addition or as an alternative to, the Websites or Services without our express written consent. In particular, Paddy Power expressly prohibits third parties from framing or similar techniques or other acts of impairment of a use experience when they visit the Websites or engage with the Services. If you engage in any of the foregoing prohibited actions, you acknowledge that damages may not be an adequate remedy for any infringement and that we are entitled to the remedies of injunction, specific performance, an order to deliver up materials which infringe our intellectual property rights and any other statutory or equitable relief and that no proof of special damages is necessary for reliance on such remedies.

31.2.1 We may wish to assign, transfer, charge or otherwise deal with our rights and/or obligations under the Terms of Use. You agree that we are free to do so provided that this will not prejudice your rights under Terms of Use. Without limiting the preceding sentence, we may wish to transfer our rights or obligations under Terms of Use to another company within the Paddy Power Group or any other legal entity, including if we restructure or there is a sale of our business. You agree that we may do so provided that in the case of such a transfer, after we notify You of the date on which such transfer takes place, Your rights under Terms of Use will be against the new legal entity. “Transfer” for these purposes includes where we assign or novate all of the rights and obligations under this Terms of use to another person, and that other person shall become the person with whom you then contract for the provision of the Services to you.

Ownership and Operation of the Poker Website

The poker room on the Poker Website is operated on behalf of Paddy Power by iPoker Network (Playtech Network Management Limited) and you will be required to accept the terms and conditions of iPoker Network’s end user licence agreement before playing in the poker room. Employees of iPoker Network (Game Park Trading Ltd) or any licensor of Games (or a member of its corporate group) are not eligible to participate in Games supplied by such licensor on the Poker Website.

Held Funds

Held funds are part of your total poker cash balance and relate to your poker winnings in the previous 72 hours. Consequently, profits arising from poker sessions are not available immediately to withdraw, they are held in a customer’s poker wallet for a period of 72 hours. Despite these funds not being available for withdrawal they are available for use at the poker table.

Poker Rules

4.1 The ‘Game Rules’ and the ‘House Rules’ on the Poker Website (or the downloaded customer software) shall apply to your participation in a poker game. In particular, you are not permitted to make a bet in excess of the value of chips on the table at the beginning of a hand. You are permitted to acquire additional chips only between hands. If you run out of chips during a hand, you are considered “all-in”. You may not remove money from the table during a playing session. Taking money out of the poker game and continuing to play is not allowed in a table bets format.

4.2 Players must refrain from “table talk” or “coffee-housing” or talking during a hand in a way that compromises an opponent’s hand. This applies if you are playing in the hand or watching the hand. Repeated abuse of this aspect of player behaviour will result in suspension or permanent restriction of play.

4.3 We are entitled to restrict seating and/or to prohibit players from playing in a particular poker game, including by restricting two or more players from playing together at the same game.

4.4 We are entitled to void any bet which has been inadvertently accepted after the time for placing bets has closed and/or where the event was resolved and/or at a stage where the player could have any indication of the outcome.

Server Crash

5.1 If you have chips at a table during a server crash, the Game will be cancelled and all of your chips at the table and in play will be returned to your Account.

5.2 In the event of a tournament crash, where less than half the players have been eliminated, the tournament will be cancelled and all monies refunded; where more than half the players have been eliminated the prize pool will be divided in half – all players will receive an equal share of half the prize money; and the other half of the prize money will be allocated to the chip leaders (chip leaders will be determined by the number of places the tournament would have paid) in proportion to their chip count.

Lotto Bets

  1. This section applies to all “Lotto”, “Lottery” and “Lottery Special” bets.
  2. By placing a lotto bet, you are betting with Paddy Power (not with the respective Lotteries). Winnings from your lotto bets will be paid by Paddy Power.
  3. All lotto bets are based on the numbers that are drawn from the respective Lotteries. Bonus Ball(s) will be included if the option is selected at the time that the bet is placed.
  4. The dates and times on our Website are in GMT.
  5. All lotto bets for a specific draw must be placed and confirmed before the first number is drawn. If, for any reason, a bet is placed after the first number is drawn, the bet will be void and the stakes returned, regardless of whether the bet would have won or lost.
  6. Should a lottery provider introduce an additional draw to take place immediately following another draw, bets timed and dated for that day will stand against the first draw(s) to take place.
  7. All bets are valid for the draw that is the bet is placed. The bet can be viewed immediately after placing your Lotto bet or alternatively My Bets sections. If the bonus ball(s) have been selected this will be indicated on the confirmation.
  8. If a lotto draw time is re-scheduled to another time within 12 hours of the advertised time of the draw all bets on that draw will stand unless the bets placed are late.
  9. If a lotto draw time is re-scheduled by more than 12 hours of the advertised time of the draw all bets on that draw will be deemed void and stakes returned.
  10. If, for any reason, Paddy Power is unable to obtain all the details necessary to settle any market for a specific draw within 48 hours, then all bets on that market will be void.

Use and interpretation

1.1 In addition to Paddy Power’s Terms and Conditions, Privacy Policy, Cookie Policy, Trust Deed and Dispute Resolution, fantasy sports contests at Paddy Power are governed by the following rules (the “Fantasy Rules”).

1.2 These Fantasy Rules include the Scoring section, which explains how the scoring system works for each fantasy sports contest.

1.3 These Fantasy Rules apply to all contests on the Fantasy tab of Paddy Power. If there is any inconsistency between the Fantasy Rules and Paddy Power’s General Sports Rules, these Fantasy Rules shall prevail relating to all fantasy sports contests.

Eligibility

2.1 You must be 18 years of age or over, and resident in the UK or the Republic of Ireland, to take part in fantasy sports contests with Paddy Power.

2.2 Employees of Paddy Power and/or employees of any company within the Flutter Entertainment plc group of companies, are not permitted to enter fantasy contests open to the public.

Shared Platform

3.1 Paddy Power’s product is pooled with FanDuel, which offers fantasy sport contests to customers in the United States. FanDuel and Paddy Power are group companies owned by Flutter Entertainment plc.

3.2 As the fantasy game is based on a shared platform with FanDuel, the base currency for the game is the US Dollar (USD). Although the game may include references to USD, all entry fees will be displayed and collected by Paddy Power using the customer’s local currency (e.g. Euro or Pound Sterling).

Irregular play

4.1 We want everyone to play fantasy sports in a fair manner. There are a variety of behaviors and types of play that we consider to be detrimental to Paddy Power and/or other customers who are playing fantasy sports. Examples of detrimental play include:

4.2 Where we have reasonable grounds to believe that you have participated in, or have been engaging in detrimental play, we may suspend your Paddy Power account and/or prohibit you from further use of the fantasy sports product.

  • breaching any term of these Fantasy Rules; or
  • taking unfair advantage over us or any other player or otherwise acting in an unfair manner (for example, by exploiting a fault, loophole or error in our software, by collusion or by any other means).

User Names

5.1 Paddy Power will provide you with an autogenerated username to play the game.

5.2 All customers will have the option to change their username once. If further changes are required, you will need to contact the Customer Services team.

5.3 Paddy Power may require users to change their user names in cases where the name is offensive or promotes a commercial venture. The requirement to change will be determined at Paddy Power’s sole discretion, and if requests are ignored, Paddy Power may unilaterally change a player’s user name.

Player Experience Badges

6.1 Paddy Power will identify those players with certain levels of experience and/or expertise with an experienced or highly-experienced player (“HEP”) badge. These badges will appear alongside the player’s username, and such players may not enter beginner contests, and are also ineligible to enter certain contests reserved for players who do not have an HEP badge. A player will be tagged with an HEP badge according to the following criteria:

Unfilled Contests

7.1 All open contests that are completed on Paddy Power have a predetermined prize pool and number of entrants. Contests labeled as “Guaranteed” will always run and pay out regardless if the contest starts as unfilled. Some structured contests, however, require a specified number of participants. If that number of participants is not reached before the start of the contest, the contest will not take place and your entrance fee will be refunded. For example, a head-to-head challenge cannot take place without two willing competitors and a 10-person league will not be conducted with only 9 interested participants.

Contest Lock Times

8.1 We offer contests with and without late swap.

8.2 For contests that do not offer late swap, all edits will be final at the pre-announced time as listed for that contest (this is usually the scheduled start time for the first game of the slate). That means no more entries and no more lineup changes. Let’s say you’re looking to join a Sunday NFL contest and the first game in which players are eligible for selection in that contest kicks off at 10:00pm that day. You’ll need to enter and make your last lineup change by 9:59pm – not a minute later..

8.3 If a contest offers late swap, players in your lineup can be edited until their respective scheduled game start time. Something to keep in mind is that all normal editing rules apply – you can select up to four players from one team, must select players from at least three different teams, and cannot exceed the salary cap. Additionally, you cannot swap for a player after their game has started.

8.4 For Golf, contests lock before the first tee-time of the tournament’s opening round. However, Paddy Power can update the lock time in the event the tournament begins before the scheduled lock time. In the event that the first tee-time of the tournament’s opening round occurs before contest lock, any new entries made or entries with edits made after the first tee-time of the opening round will be cancelled and refunded.

8.5 For NASCAR, contests lock before the race’s scheduled start time. However, Paddy Power can to update the lock time in the event the race begins before or after (in the case of postponed races) the scheduled lock time. In the event that the race officially begins before contest lock, any new entries made or entries with edits made after the race began will be cancelled and refunded.

8.6 For single game 2nd half slates, only the stats accumulated in the 2nd half of the game and overtime (if necessary) will count towards point totals. The start of the contest is determined by the scheduled start time of that contest, as stated in the contest details. Paddy Power can push back the start time of a single round half slate contest if the 1st half of the underlying game is not over before the scheduled start time of the contest. In such a scenario, Paddy Power will push back the start time of the contest to 10 minutes after the end of the 1st half.

Maximum Entries

9.1 All contests have limits on the maximum number of entries that a single user may submit. These limits will be specified in the description of each contest. While these limits may vary, you will generally not be allowed to submit multiple entries exceeding:

9.2 For Golf, Paddy Power may offer contests with higher limits on the maximum number of entries a single user may submit.

  • 3% of the total Entries for contests with 2 to 4999 Entries
  • 150 Entries for contests with 5000 or more Entries

Cancelling Entries

10.3 Entries can be cancelled by clicking on the ‘cancel entry’ link located at the bottom of your entry on the roster confirmation page, or by clicking the red ‘x’ next to your entry at your Upcoming page.

10.4 Paddy Power has no obligation to honour cancellation requests that are not received, or which are received after these deadlines, due to technical difficulties or other reasons.

Postponed Games

11.1 Rules for how postponed games are treated in Paddy Power contests vary depending on the sport and contest type. For NFL contests, you will receive points for any postponed games that are played no later than Wednesday of that week. For one day MLB, Basketball, NHL and Soccer contests, if the postponed game is played on the same day then you will receive points for your players in those games as normal. If a game is postponed to a later date or called off for any reason, any players you have selected for that game will receive zero points. For NASCAR contests, if a race is postponed and is not rescheduled to run before the Wednesday following the start of the race, all entry fees will be refunded. For any Basketball, MLB, NHL and Soccer contests that are scheduled to include games from multiple days (such as some playoff contests), you will receive points for any games that are played no later than the day after the last game scheduled as part of the contest. For slates involving multiple games, if game cancellations and/or postponements mean there is only one game left in a contest, then the contest will be canceled and all entry fees will be refunded. NOTE: A game will be considered to be ‘played’ on a given day if it begins on that day and is completed no later than 6am Eastern on the following day. For Golf contests, postponed rounds will only be counted if they are completed before the Wednesday following the start of a tournament. For College Football contests, you will receive points for any postponed games that are played within three days of the originally scheduled game. For example, if a College Football game is scheduled to start on Saturday, the game must be played by the following Tuesday.

Suspended Games

12.1 Rules for how suspended games are treated vary depending on the sport and game type. A game is considered suspended if it is unfinished, but to be completed in the future. At a minimum, the statistics compiled prior to the end of the contest period will count towards contests. For a suspended NFL game, you will receive points for the remainder of the game if it is played no later than Wednesday of that week. For one day MLB contests, if the game is suspended until a future date, points accumulated in the remainder of the game will not count towards contests. For one day Basketball, NHL and Soccer contests, you will receive points for any suspended games that are played no later than the next day. For any Basketball, MLB, NHL and Soccer contests that are scheduled to include games from multiple days (such as some playoff contests), you will receive the remaining points for the any games that are completed no later than the day after the last game scheduled as part of the contest. For Golf contests, if a tournament is suspended after rounds have been played, and it will not complete within a week from the event start date, the game will be marked complete and the future scores will not count towards settlement.

12.2 If a Golfer withdraws from play mid-competition he will only receive points for his completed holes. For example, if a Golfer withdraws on the 16th hole of the first round, he will receive points earned through the first 15 holes. Incomplete rounds are not eligible for the ‘Bogey Free Round’ bonus.

12.3 Entries can be cancelled by clicking on the ‘cancel entry’ link located at the bottom of your entry on the roster confirmation page, or by clicking the red ‘x’ next to your entry at your Upcoming page.

12.4 For NASCAR contests, if a race is suspended after laps have been completed, and it will not finish before the Wednesday following the start of the race, the race will be marked complete and the future scores will not count towards settlement.

12.5 For a suspended College Football game, you will receive points for the remainder of the game if it is played within three days of the originally scheduled game. For example, if a College Football game is scheduled to start on Saturday, the game must be played by the following Tuesday.

12.6 For single game half slate contests, if the game is suspended prior to the start of the 2nd half or quarter included in the contest, all entries will be voided and entry fees refunded. If an NFL game is suspended during the 2nd half or quarter being played in the contest, you will receive points for the remainder of the game if it is played by the end of that day. If a Basketball, NHL and Soccer game is suspended during the 2nd half or quarter being played in the contest, you will receive points for any suspended games that are played no later than the next day.

Contest Player Pool and Traded Players

13.1 Players being traded may impact contests that have already been created with the players on their old teams. Player team listings on Paddy Power are updated once per day. Note that because contests are created as much as five or six days in advance, traded players may not be available in contests which include a game involving their new team, but not their old team. Also note that in some instances a player you selected may no longer be available in a contest which includes their old team, but not their new team. In that case, you’ll need to select a replacement or be credited with zero points for the player.

13.2 Note that on the day a player is traded, they may still be listed for their old team in the draft screen. If they are traded to another team which is part of the same contest in which you choose them, you will still receive points for their performance. These points may not be reflected accurately during live scoring, but will count at contest settlement time. Also note that contest settlement may be delayed in order to ensure accuracy.

13.3 Most importantly, please note that in very rare cases a player is traded early enough in the day that they are able to play for their new team. If they are traded from a team with a late game to a team with an early game, you may be able to select them in late contests, already knowing how they performed that day. In this situation, you will receive zero points for their performance.

13.4 In rare cases, Paddy Power can update the pool of players for a contest slate before lock time at its own discretion. In the event that this takes place, Paddy Power will contact users currently entered into that contest slate to alert them of this change.

Player Status Indicators

14.1 When drafting a lineup, you may see player status indicators informing you of a player’s injury status, whether he’s active in the lineup or other information relating to a player’s status in the lineup (e.g., batting order for baseball, projected line for hockey, etc.).

14.2 As you build your lineup, you may consult the Indicator Legend at the bottom of the draft screen for more information on Player Status Indicators.

14.3 These indicators are based on information provided to us by a 3rd party, and while we do our best to ensure accuracy, Paddy Power is not responsible for the content.

Doubleheaders

15.1 Only one game of a doubleheader will count for Paddy Power scoring. Players will only score points for the game which starts at the time listed in the contest details. This will typically (but not always) be the game at the originally scheduled time.

Lineup Restrictions

16.1 Lineup restrictions governing the mix of players allowed in your lineup vary based on contest type. For most contests, you must pick players from at least three different teams and you may not pick more than four players from the same team. However, for MLB contests, you may select up to five players from the same team, provided one player is a pitcher. For single game contests, you must pick players from at least two different teams.

Scripts

17.1 Use of unauthorized scripts is prohibited on Paddy Power. Authorized scripts will be made available through Paddy Power and will be accessible to all users prior to game entry. Currently, Paddy Power allows all users to enter multiple lineups into contests via CSV files using the “Upload Lineups” tool available on the draft screen. Paddy Power also allows users to edit multiple lineups via CSV files using the “CSV Edit” tool available on the Upcoming page and the Live page (for late swap).

Cancelling Entries

18.1 We try to settle contests and run payments as quickly as possible, but must ensure we do so accurately. Most contests are settled shortly after the last game finishes. However, to settle we have to wait until all the player statistics have been reported by our third party stats provider. This lets us ensure that the final box scores are complete. Please note there can sometimes be last minute changes. If there is difficulty obtaining official results or issues with scoring, the contest may be settled the following day.

Scoring Revisions

19.1 During every game, we receive live scoring from one of our stats providers. After each game has ended, we receive the final box score, and settle all the contests. On rare occasions, the final box scores are revised after they have been released. When that happens, the player scores on Paddy Power will not be updated and the settlements will not be revised. Note that this is not the same situation as a case where a correction needs to be made after settlement due to a problem with the data feed or the settlement process. In these cases the settlement process (including payment) may be reversed and games resettled correctly.

Service Access and Editing Problems

20.1 While we try to ensure that Paddy Power is functioning smoothly at all times, like any online service we may periodically experience periods of outage or slow performance. These can sometimes result in an inability to access the Service, problems editing lineups, or problems entering new contests. If you’re unable to access the Service, please report the problems by contacting us at Customer Support. If there are sustained periods where players are unable to access Service functionality, or otherwise prevented from editing lineups, or in certain other situations, we may provide instructions on how to cancel your entries over email prior to game time.

Service Access and Editing Problems

21.1 Paddy Power also reserves that right to cancel contests at our discretion, without any restrictions. This would typically be done only in cases where we believe that due to problems on the Service or events impacting the sporting events, there would be a widespread impact on the integrity of contests.

Disputes

22.1 Any disputes relating to Paddy Power’s fantasy sports product will be resolved in accordance with the Paddy Power Dispute Resolution Policy, see here .

Standard Promotional Terms

These Standard Promotional Terms apply to all Paddy Power promotions and competitions. Except as expressly provided, in the event of any discrepancy or conflict between these Standard Promotional Terms and any specific promotional terms, then the specific promotional terms shall prevail.

Eligibility

1.1 You must be aged 18 years or more to participate in promotions and/or take part in competitions. It is an offence for anyone under the age of 18 to open an account or to gamble. Underage entries will be void.

1.2 All promotions are limited to one entry per customer. To ensure that the promotion is limited to one entry per customer, we only permit one customer to participate from each household address, IP address, email address, telephone number, same payment account (e.g. debit or credit card, Neteller etc) or shared computer (e.g. public library or workplace).

1.3 None of the employees, nor any family members of employees, of Paddy Power and its affiliate companies, their agents, or those of their respective group companies may take part in prize draw promotions or competitions that involve any element of judgment by Paddy Power.

1.4 All promotions are available at the discretion of Paddy Power and Paddy Power can restrict the availability of a promotion to any person. Any such restriction will not impact players who have already started wagering under a promotion.

1.5 If you have been sent an email excluding you from promotions you will not qualify any promotions. Please note that any such exclusion will not affect any free bet, bonus or other promotional offer you have already placed a qualifying bet towards. You will still receive the benefits of any promotion you have started qualifying for or already qualified for prior to this decision.

Fraud and Multiple Entries

2.1 Fraudulent or multiple entries will not be accepted, neither will entries made in breach of these Standard Promotional Terms or the specific promotional terms.

2.2 Paddy Power can exclude any entrant from competitions and/or promotions and from use of the Paddy Power website if Paddy Power believes that an entrant has tried to enter by using more than one username or is otherwise engaging in any fraudulent or illegal activity (including participation that would be in breach of the law in your local jurisdiction), whether or not that entrant would or might have won any prize but for such activity. Where fraudulent entries or multiple entries/accounts have been used, Paddy Power can cancel these accounts and withhold payment of the prize/bonus or any other promotional benefits.

Bonuses

3.1 Bonuses are awarded to enhance your enjoyment of our games however we reserve the right to govern how bonuses are used before a player is allowed to cash them in. As such we deem it necessary to restrict certain types of wagering from contributing to the wagering/turnover requirements..

3.2 Any bonus issued is valid for a period of 7 days from the date of issue unless otherwise stated in the specific promotion. Any remaining/unused bonus at the end of the stated period will be removed from the player’s account.

3.3 All bonuses credited must be ‘bought-in’ to, accepted or declined. Once accepted, a bonus is credited to your playable balance. Declined bonuses will not be reapplied.

3.4 Wagering requirements for bonuses will apply to an account from the time a bonus is accepted and/or applied to an account.

3.5 When receiving a bonus, the player will first play with the money ‘bought-in’ to and only then will the player play with the bonus offered by the casino.

Irregular play

4.1 If Paddy Power becomes aware of a customer who, in the course of participating in a promotion or offer, has become able to guarantee wins and/or profits with no or only minimal risk, and/or benefits from a promotion or offer by participating through more than one Paddy Power account, and/or displays irregular or unusual playing or betting patterns which Paddy Power deems to be abusive, Paddy Power may elect to do any one or more of the following: (i) close the customer’s account(s); (ii) invalidate the transactions or game play which was in contravention of this term; and/or (iii) withhold the customer’s winnings from such transactions or game play.

Paddy Power can withhold any withdrawals and/or confiscate all winnings for irregular play. Irregular play includes, but is not limited to, any one or more of the following types of play:

  • Placing single bets equal to or in excess of 30% of the value of the bonus and deposit before the wagering requirements for that bonus have been met. For example, you deposit €/£100, accept a €/£100 bonus and place a single bet of €/£60 on any game.
  • Moving from a low weighted game (25% or less) to a high weighted game (100%) after large wins for the purpose of clearing wagering requirements. For example, you place at least one bet on any game weighted at 25% or less, win 100% more than your stake and move your original stake and winnings to a game weighted at 100% in order to meet wagering requirements.
  • Playing equal to or more than 500 auto spins on a Slot machine and/or playing a Slot machine consistently for a period longer than two hours while a bonus is active. For example, you set any game to run on auto spin for 500 spins while you have an active bonus in your account and/or you play for a period of two hours or more (irrelevant of how many sessions) while you have an active bonus.
  • Low risk Roulette bets. ANY bet spread combination on Roulette games covering 25 or more (67%) of the 37 unique number spots on the table. For example, you bet on Red and Black, you are covering 36 of the 37 possible outcomes, therefore this bet would not count towards any wagering requirements.

Prizes

5.1 Prizes are not transferable or exchangeable other than at the sole discretion of Paddy Power.

5.2 Unless otherwise specified in writing, if you are required to travel as part of the promotion or as a competition prize winner, you are responsible for making all your own arrangements (including insurance).

5.3 For prizes which are time sensitive or have a natural expiry date (for example, tickets to a particular match or event), then we will attempt to contact all winning customers via their registered contact details on Paddy Power (and, if the competition took place on social media, via the winner’s social media account) within 48 hours of the end of the competition. If we cannot reach you within 48 hours, or if you do not claim your prize within 48 hours of being notified, we reserve the right to select a new winner. For prizes which are not time sensitive, no such time limit shall apply.

5.4 Paddy Power reserve the right to credit prizes as cash.

Publication

6.1 Paddy Power may publish, or make available on request, details of any prize winners including first name, location and country along with winnings and prizes received. If you are a winner, we may pass your personal details on to third parties to deliver/supply/arrange the prize. By entering a promotion you agree that Paddy Power may use your information to contact you about the promotion. Please contact us if you wish to object or reduce the amount of your information we publish or make available for the purposes of the promotion. This is distinct from publicity which is dealt with in clause 20 below.

6.2 If you win a competition or a promotion, Paddy Power may ask you if you wish to take part in publicity. If you agree to take part, Paddy Power can make reasonable use of your name and image on the websites and in promotional materials.

Variation

7.1 Paddy Power can amend any specific promotional terms, competition rules or these Standard Promotional Terms at any time. Any such change will not adversely impact players who have already started wagering under a promotion.

7.2 Paddy Power can withdraw or vary the terms of competitions and promotions to comply with the decision of any relevant judicial or regulatory body and shall not be held liable to any entrant for so doing.

General

8.1 By entering the promotion or competition, you accept and agree to be bound by these Standard Promotional Terms and any specific terms and conditions relating to the relevant promotion.

8.2 Any disputes relating to promotions or competitions will be resolved in accordance with the Paddy Power Dispute Resolution Policy, see here.

1.1 Live Video is available to customers on all platforms to customers with a funded account.

1.2 The territories to which we are able to stream events vary from sport to sport. The list of scheduled matches will reflect which events you can view from within your particular locale.

1.3. Live Video is currently free of charge for all content with the exception of certain horse racing and greyhound events(see below for further details).

Fixed Odds/Sportsbook – Horse Racing and Greyhounds

2.1 UK, Ireland, US, RSA and India horse racing, races are free to watch as long as you have a funded account.

2.2. For French, UAE, Germany, Mauritian and Latin American horse racing, a minimum total stake of EUR1.00 or GBP1.00 (or currency equivalent) must be placed in order to watch a single race. This can be in the form of a £/€1.00 single or £/€0.50 each-way bet.

2.3. The qualifying criteria for multi-leg bets that include races where a minimum bet requirement is in place are detailed in the table below:

In multi-leg bets the average stake per race must meet or exceed the minimum qualifying amount of EUR1.00 or GBP1.00 or currency equivalent, in line with the examples below:

2.4. All greyhound races, other than SIS races, are free to watch as long as you have a funded account.

2.5. SIS races require a minimum matched bet of GBP1.00 (or currency equivalent) must be placed on the relevant ‘day of the race’ market to qualify to watch that particular race. This can be in the form of a £1.00 single or £0.50 each-way bet.

2.6. Antepost and Special bets do not qualify.

  • A GBP2 double would qualify you to watch both races. A GBP1.00 double would only qualify you to watch the first race by scheduled off time.
  • A GBP0.40 Yankee would qualify you to watch all 4 races as the average stake per race is more than GBP1.00 – (GBP4.40 in total).
  • A GBP6 8 fold accumulator would qualify you to watch the first 6 races, but not the 7th or 8th as the average stake per race is below the minimum unit amount of GBP1.00.
  • Straight accumulators no longer qualify for live video after the point one leg is settled as a loser.

WARNING STREAMING TIME DELAY

3.1. ALTHOUGH CONTENT ON LIVE VIDEO IS ADVERTISED AS “LIVE”, YOU SHOULD BE AWARE THAT LIVE VIDEO IS SUBJECT TO A TIME DELAY. The precise length of the time delay will vary depending on a number of factors, but you should typically expect a time delay of between 2 and 5 seconds behind the actual event. The time delay may sometimes be significantly longer than this.

3.2 IF YOU RELY ON LIVE VIDEO TO PLACE BETS, YOU DO SO ENTIRELY AT YOUR OWN RISK. Paddy Power accepts no responsibility for any loss suffered by you as a result of your reliance on Live Video.

EXCLUSION OF LIABILITY

4.1. Paddy Power does not make any representations or warranties, express or implied, that Live Video will meet your requirements, that the operation of Live Video will be uninterrupted, on time or error free, that Live Video will be available during any specified hours (whether advertised or not), or that Live Video will operate in conjunction with any particular software or hardware.

4.2. Paddy Power shall not be liable to you for any direct or indirect loss, including any loss of profit, data, business or goodwill, arising in connection with your use of or reliance on Live Video. Paddy Power shall not be liable for the capacity, reliability, availability or performance of Live Video.

Changes to Live Video content

5.1. All content on Live Video is subject to change and Paddy Power may vary, suspend, replace or withdraw content on Live Video at its absolute discretion and without notice.

5.2. Paddy Power reserves the right to modify, suspend or discontinue the Live Video service at any time without notice to you.

Intellectual Property Rights​​​​​​​

6.1. Live Video is for personal non-commercial use only. You are strictly prohibited from copying, saving, modifying or distributing the Live Video content (or assisting a third party to do so) or allowing any third party to access the Live Video content.

6.2. You must not sell or make any charge for watching or using any part of Live Video, nor show any part of Live Video in public to an audience (even if no charge is made), nor authorise or assist any third party to do any of the same.

6.3. The content on Live Video is licensed to Paddy Power by third parties.

General

7.1. Paddy Power reserve the right to change these terms and conditions at its discretion from time to time. If we make significant changes to these terms and conditions, then we will take appropriate steps to bring such changes to your attention. It is your responsibility to check these terms and conditions from time to time to ensure that you agree with them and your continued use of Live Video will be deemed to be your acceptance of any changes to the terms and conditions.

7.2. These terms and conditions are governed by English law and any disputes will be dealt with by the English courts.

7.3. Paddy Power reserve the right to introduce other fees, subscriptions or charges or conditions for access to Live Video in the future. You will be made aware of the introduction of any charge or condition before it is introduced.

7.4. Paddy Power may refuse access to Live Video to any customer at its absolute discretion.
